Evidence & Certification Disclaimer
Evidence & Certification Disclaimer
Effective Date: January 1, 2026 Version: 1.1 Last Updated: March 1, 2026
This disclaimer governs the interpretation and use of all evidence packages, certified reports, Defendibility Scores, and related outputs generated by the Estimatics platform. Users of the CERTIFY plan should read this document carefully before using Platform outputs in appraisal, litigation, or regulatory proceedings.
1. Nature of Evidence Generated
The Estimatics Platform captures and organizes field evidence — photographs, videos, GPS coordinates, timestamps, and property measurements — submitted by professional users. The Platform does not independently collect evidence. All underlying evidence is captured by a human inspector using the Estimatics iOS application.
2. Certified Evidence (CERTIFY Plan)
2.1 What Certification Covers
On the CERTIFY plan, the Certified Evidence feature applies a SHA-256 cryptographic hash chain to the following elements at the time of capture or upload:
- Original photographs (unmodified)
- Original video recordings
- GPS coordinates and altitude data
- Capture timestamps (device time, synchronized with NTP)
- Device identifier and app version
- AI findings generated from the above evidence
2.2 What Certification Proves
A valid Certified Evidence package demonstrates:
- The evidence existed in the certified state at the recorded timestamp
- The evidence has not been modified, deleted, or reordered since certification
2.3 What Certification Does Not Prove
Certification does not independently verify:
- The accuracy of GPS coordinates (subject to device GPS precision, typically ±5 meters)
- The identity of the person who captured the evidence
- The physical condition of the property at times other than the capture timestamp
- The professional qualifications or licensure of the capturing inspector
- The legal sufficiency or admissibility of any evidence item in any jurisdiction
2.4 Annotated vs. Original Evidence
The Platform preserves both original (unmodified) and annotated (marked-up) versions of photographs and videos. Annotations are stored as a separate layer and do not modify the original file. The original file is the certified artifact. Annotated versions are derived works and are not independently certified.
3. AI-Generated Content in Evidence Packages
AI findings included in an evidence package — damage classifications, scope items, narrative descriptions — are the output of machine learning models. They are included in the certified package as a contemporaneous record of what the AI observed.
AI findings are not certified facts. They are AI-assisted observations that require review and validation by a licensed professional before being relied upon in any official proceeding.
4. Defendibility Score
The Defendibility Score is a 0–100 rating generated by the Platform to help professionals assess the completeness and quality of their documentation before submission. It is a quality guidance tool — not a legal assessment or admissibility guarantee.
A high Defendibility Score indicates that documentation follows the Platform's internal quality criteria. It does not constitute an opinion of counsel or a guarantee that the evidence will be found credible, admissible, or sufficient in any administrative, appraisal, or judicial proceeding.
5. Professional Responsibility
Platform outputs — whether certified or uncertified — are tools for licensed professionals. The professional submitting any claim, report, or evidence package bears full responsibility for:
- Verifying that the evidence accurately represents the property condition
- Applying independent professional judgment to all AI-generated outputs
- Ensuring compliance with all applicable professional licensing requirements
- Ensuring compliance with applicable state and federal insurance regulations
6. Jurisdiction-Specific Considerations
The legal standards for electronic evidence admissibility vary by jurisdiction. Users intending to use Certified Evidence in litigation or regulatory proceedings should consult qualified legal counsel in the relevant jurisdiction to assess admissibility under applicable evidentiary rules.
7. No Legal Advice
Nothing in this document, or anywhere in the Estimatics Platform, constitutes legal advice. Estimatics is a technology company, not a law firm. Users requiring legal advice regarding evidence, insurance claims, or regulatory compliance should consult a licensed attorney.
